12 SANDF Members Deny Murder Charges in Randburg Bail Hearing
The bail hearing for twelve members of the South African National Defence Force (SANDF) accused of involvement in the abduction of two Ethiopian nationals and the murder of Hawks investigator Lt‑Col Frans Mathipa resumed at the Randburg Magistrate’s Court on Tuesday.
The accused face a spectrum of serious charges, including three counts of murder, kidnapping, fraud, perjury, theft of a motor vehicle, and obstruction of justice. Prosecutors allege they abducted Ethiopian businessman Abdella Hussain Abadiga and his bodyguard from the Mall of Africa in December 2022, allegedly killing them, and later murdered Lt‑Col Mathipa, who was investigating the disappearance.
The 12 soldiers entered not guilty pleas, vehemently denying all charges. In their affidavits, they argued the state’s case is “very weak”, asserting they were engaged in a sanctioned military exercise on the day of the alleged abduction and murders. Some stated they had no knowledge of the suspected victims and accused the prosecution of malicious intent.
NPA spokesperson Phindi Mjonondwane confirmed the state will rely on precedent set by the Rasuge case to strengthen the murder charges related to the Ethiopian nationals. The NPA emphasized that an investigating officer’s affidavit—which details address verifications and potentially classified documents—will be presented in court during Thursday’s session.
With identities still withheld pending an identity parade, the court has ordered that no names or photographs be released. All 12 remain in custody, with bail postponed to Thursday, 3 July, to allow verification of addresses and review of the investigating officer’s affidavit.
The state anticipates presenting further supportive documents and evidence, while the defence will continue to push for release based on weak evidentiary claims.
Should bail be denied, the case is expected to be transferred to the Gauteng High Court for a full trial.
